IIRC the Senate was design as a compromise to reflect the will of the states in the new republic. Requiring mid-term replacements to be elected would be a huge step forward as currently they are rarely ever reelected if they are appointed to serve. Unfortunately most people don’t know/care about DRM and probably won’t be upset about it until they lose the music they paid for, in this instance by buying a new cell phone.
